1. These Terms
1.1 These terms and conditions set out the basis upon which UK Event Medix Ltd supplies Event First Aid and Event Medical Services.
1.2 Together with the quotation, booking confirmation and any agreed amendments in writing, these terms form the Contract.
1.3 The Contract becomes effective when UK Event Medix Ltd issues written confirmation of the booking.
2. Definitions
'Agreed Price' means the amount detailed within the quotation.
'Event' means the event detailed within the quotation.
'Event Lead' means the UK Event Medix Ltd representative responsible for managing service delivery.
'Personnel' means employees, volunteers, contractors and subcontractors engaged by UK Event Medix Ltd.
'First Aid Cover' means the first aid and event medical services described in the quotation.
'Designated Treatment Area' means the treatment area provided by the organiser.
3. Booking Services
Bookings are subject to availability. We may decline a booking where resources are unavailable, information is incomplete, or we believe the proposed level of cover is inadequate for the risks presented.
4. Our Obligations
We will provide appropriately trained, competent and insured personnel.
We will provide services with reasonable care and skill.
We will appoint an Event Lead.
We will maintain appropriate clinical governance arrangements.
We will operate in accordance with relevant legislation, recognised industry guidance and accepted best practice.
5. Organiser Obligations
The organiser is responsible for ensuring a suitable risk assessment has been completed.
The organiser must provide accurate information regarding attendance, activities, hazards and event arrangements.
The organiser shall provide access, welfare facilities, parking where applicable, communications arrangements and treatment facilities where required.
The organiser shall ensure all necessary permissions, licences and insurances are obtained.
6. Event Medical Planning
Any event medical plan prepared by UK Event Medix Ltd is provided solely for the purpose of delivering our services and does not replace the organiser's overall responsibility for event safety.
7. Changes to Bookings
Requests for amendments must be made in writing.
Additional resources may incur additional charges.
Where event risks change significantly, UK Event Medix Ltd reserves the right to require revised cover levels.
8. Operational Control
The Event Lead retains responsibility for deployment and management of UK Event Medix Ltd personnel.
All clinical decisions remain the responsibility of UK Event Medix Ltd personnel.
9. Limitations on Service Delivery
If circumstances arise that compromise safety, personnel welfare or clinical effectiveness, services may be suspended until risks are addressed.
Personnel may temporarily leave the event to obtain further assistance for a patient where necessary.
10. Payment Terms
A booking deposit of 50% may be required.
Final invoices are payable within 14 days of the commencement of your event unless otherwise
agreed.
Late payments may incur interest at 4% above the Bank of England base rate.
The client shall be responsible for reasonable recovery costs.
11. Event Overruns
Where an event exceeds agreed operating hours, additional charges may apply.
UK Event Medix Ltd is not obliged to provide services beyond the agreed finish time.
12. Insurance
UK Event Medix Ltd maintains Public Liability and Professional Indemnity Insurance.
Evidence of insurance may be supplied upon request.
The organiser must maintain adequate insurance including public liability cover.
13. Patient Records and Confidentiality
Patient information shall be processed in accordance with UK GDPR and applicable data protection legislation.
Clinical records remain the property of UK Event Medix Ltd.
Patient information will only be disclosed where lawful and appropriate.
14. Data Protection
UK Event Medix Ltd will process personal data in accordance with its Privacy Notice and applicable legislation.
15. Intellectual Property
All logos, documents, forms, policies, procedures and materials remain the intellectual property of UK Event Medix Ltd unless otherwise agreed.
16. Complaints
Complaints should be submitted in writing.
UK Event Medix Ltd will investigate complaints fairly and proportionately.
17. Liability
Nothing within these terms’ limits liability for death or personal injury caused by negligence, fraud or any liability which cannot lawfully be excluded.
Subject to this, liability shall be limited to the value of the Contract.
UK Event Medix Ltd shall not be liable for indirect or consequential losses, loss of profit, loss of opportunity or reputational damage.
18. Force Majeure
UK Event Medix Ltd shall not be liable for delays or failure arising from events beyond its reasonable control including severe weather, industrial action, government action, pandemic events, national emergencies or utility failures.
19. Cancellation
30 days or more before the event: no cancellation fee.
15–29 days before the event: 50% of agreed charges.
7–14 days before the event: 75% of agreed charges.
Less than 7 days before the event: 100% of agreed charges.
20. Termination
Either party may terminate the Contract where the other commits a material breach.
UK Event Medix Ltd may terminate immediately where safety, legality or non-payment concerns arise.
21. Subcontracting
UK Event Medix Ltd may engage suitably qualified subcontractors or partner organisations where necessary.
22. No Ambulance Service Statement
UK Event Medix Ltd provides event first aid and event medical services.
Unless specifically agreed in writing, UK Event Medix Ltd does not provide ambulance transport services, patient conveyance services or regulated activities requiring registration with the Care Quality Commission.
23. Governing Law
These terms are governed by the laws of England and Wales and subject to the exclusive
jurisdiction of the courts of England and Wales.
